Hernando’s Case Results

  • Client was charged with Assault on a Peace Officer, Preventing Arrest and Criminal Mischief. Hernando defended his client at trial and was able to prove that his client was not aggressive, and that Law Enforcement Officers put hands on client and tazed him without trying to deescalate the situation. The Jury came back with a verdict of Not Guilty on all charges.

  • Client was charged with Possession of Drug Paraphernalia a Class C Felony. Hernando filed and argued a motion to suppress evidence since the clients rights were violated during the traffic stop.   • Client was charged with Terrorizing a Class C Felony with a mandatory 2 year jail term and Reckless Endangerment a Class C Felony.  Hernando was able to negotiate a Deferred Imposition of Sentence for Count One which was reduced to a Misdemeanor charge and Count Two was Dismissed. This outcome resulted in the client NOT being convicted of any Felony charges.

This outcome resulted in the client NOT being convicted of any Felony charges and all charges ultimately being dismissed at the end of the probation period.

  • Client was charged with Gross Sexual Imposition a Class AA Felony.  This charge had a mandatory minimum 20 years of imprisonment. Hernando was able to depose the accuser and show that the sexual contact was not inflicted by force or threat. The charge was reduced to a Misdemeanor charge and the client did not have to register as a sex offender.

  • Client was charged with Theft of Property a Class B Felony and Conspiracy to Commit Theft a Class B Felony. This outcome resulted in the client Not being convicted of any Felony charges.

  • Client was charged with Two Counts of Gross Sexual Imposition a Class AA Felony and Class A Felony. Jeff and Hernando worked together as a team. They deposed the medical examiner in order to prove that the alleged victim did not have signs of being sexually assaulted. Hernando was ready to defend his client at trial, but the prosecution dismissed the case seven days before trial was to begin.

Law Enforcement arranged for a confidential informant to make a controlled buy from client.  Hernando was able to negotiate that the charge be reduce to a misdemeanor. Even misdemeanors can severely affect the client.

  • Client was charged with Domestic Violence Aggravated Assault Use of a Dangerous Weapon a Class C Felony. This charge carried a 2-year mandatory prison sentence. Hernando was able to point out the inconsistencies of the case and the prosecution ultimately dismissed the case against the client.

  • Client was sentenced to 24 years of imprisonment. Jeff filed a motion to serve the sentence concurrently. The court granted the motion and the office of the Attorney General appealed. Hernando filed his motion with the Supreme Court. Ultimately the Supreme Court sided with Hernando’s arguments. The Supreme Court affirmed the District Court’s decision. This resulted in a reduction of 12 years off from the client’s sentence.
